Terms of use
Updated
These terms govern your use of the Melomany app and this website. Read them together with the privacy policy.
Who we are and acceptance
Melomany is a service of Heronima S.A.S., a Colombian company with tax ID (NIT) 902.116.536-7, registered in Bogotá, Colombia. You can write to us at [email protected].
By creating an account or using Melomany, you accept these terms. If you don’t agree, don’t use the service.
Eligibility and accounts
- You must be at least 16 and, where your country’s law requires it, have the authorisation of a parent or legal guardian.
- Your account details must be true, and each account belongs to one person.
- Look after your password and access to your email and phone. You’re responsible for what’s done with your account.
- Melomany is free. If we ever offer paid features, we’ll tell you first, with their conditions.
Your content in groups and chat
What you share on Melomany (group names and descriptions, battle topics, tracks, votes, notes and messages) remains yours. You give us permission to store it, show it to the right people and process it to run the service, for as long as it exists on Melomany.
Don’t post content that:
- is illegal, or infringes other people’s rights, including copyright and trademarks;
- harasses, threatens, discriminates, or incites hatred or violence;
- is sexual or explicit, and never if it involves minors;
- impersonates someone, deceives, or is spam.
We don’t tolerate abusive content or the people who post it. You can report content or a person by writing to [email protected] with the group, the person and what happened. We review every report within 24 hours and may remove the content and suspend or close the account responsible. A group’s host can also remove members and delete chat messages.
Platform content
Tracks, covers and previews belong to their rights holders and reach us from Apple, Spotify, YouTube, TIDAL and Deezer. Melomany isn’t affiliated with those platforms. Previews are there to identify each track; to hear it in full, open its link, which is governed by that platform’s terms.
Suspension and termination
You can stop using Melomany whenever you like and ask us to delete your account, as the privacy policy explains.
We may suspend or close your account if you break these terms or the law, or if it’s needed to protect other people or the service. Except in serious or urgent cases, we’ll warn you first and tell you why.
Liability
We offer Melomany as it is and do our best to keep it working well, but we don’t guarantee it will always be available or free of errors. As far as the law allows, we aren’t liable for indirect damage caused by its use, or for content other people post.
None of this limits your rights as a consumer, in particular under Colombia’s Law 1480 of 2011 or the consumer rules of your country of residence in the European Union, nor our liability where the law doesn’t allow it to be limited.
Governing law and jurisdiction
These terms are governed by Colombian law, and any dispute belongs to the courts of Bogotá, Colombia. If you’re a consumer living in another country, you keep the protection of that country’s mandatory rules and can go to its courts.
Changes to these terms
If we change these terms, we’ll update the date above. If the change is significant, we’ll tell you in the app before it applies. If you keep using Melomany afterwards, you accept the new terms.
